Workers' Compensation — New Brunswick
New Brunswick workers' compensation is administered by WorkSafeNB (formerly WHSCC). The Workers' Compensation Act governs claim filing, decision-making, and appeals. WorkSafeNB's current forms require workers to choose their preferred language for correspondence.
Key Requirements
Acknowledgment
Worker must file an application for compensation with WorkSafeNB with any attending physician's certificate. Employer must report injuries promptly. The statutory application deadline is within 1 year after the date of accident (6 months for death cases).
Denial
WorkSafeNB must issue written decisions on claims. The worker-facing form states it will not be processed until all required information is received.
Mandated Forms
- Application for Workers' Compensation Benefits: Worker's initial claim form
- Employer's Report of Accident
- Attending physician's certificate
Language Choice
Workers must choose their preferred language (English or French) for correspondence when filing claims, consistent with New Brunswick's bilingual requirements.
Appeals
Workers may appeal WorkSafeNB decisions through the internal review process and then to the Workers' Compensation Appeals Tribunal.
