Workers' Compensation — Ontario

Ontario workers' compensation is administered by the Workplace Safety and Insurance Board (WSIB). The WSIA and WSIB's Operational Policy Manual (OPM) govern claims correspondence, forms, and decision requirements.

Key Requirements

Acknowledgment

Employer must submit Form 7 within 3 business days after learning of a workplace accident that necessitates health care or causes inability to earn full wages. WSIB policy treats reduced pay, absence, or modified work at regular pay for more than 7 calendar days as reporting triggers.

Denial

WSIB must issue written decisions on claims. Workers may appeal to the WSIB Appeals Branch and then to the Workplace Safety and Insurance Appeals Tribunal (WSIAT).

Mandated Forms

  • Form 7 (Employer's Report of Injury): Must be Board-approved format; worker must receive a copy. Penalty: $250 for late/incomplete, $1,000 if more than 30 days late.
  • Form 6 (Worker's Claim for Benefits): Worker's initial claim filing
  • Form 8 (Health Professional's Report): Treating practitioner report to WSIB

Employer Copy to Worker

The employer must provide the worker with a copy of what was sent to WSIB, including any additional information. Failure to provide a copy attracts penalties.
