Yukon
Yukon does not have a standalone unfair-claims-settlement-practices regulation. The main controls are in the Insurance Act and its built-in statutory conditions for specific lines, plus a broad prohibition on unfair or deceptive practices including conduct causing unreasonable delay or resistance to fair settlement.
Key Requirements
Acknowledgment
No universal acknowledgment deadline across all lines. Prompt acknowledgment is strongly advisable given the unfair-practices prohibition.
Denial
No universal denial deadline. Yukon prohibits any customary practice or conduct having the effect of causing unreasonable delay in or resistance to fair settlement of claims. Denial letters should be accurate about policy wording, specific about missing proof, and not misleading about rights or time limits.
Payment Timing
- Property: 60 days after completion of proof of loss
- Auto physical damage: 60 days after proof, or 15 days after appraisal award
- Accident-and-sickness (non-loss-of-time): 60 days after proof of claim
- Initial loss-of-time benefits: 30 days after proof, then at least every 60 days
- Life: 30 days after sufficient evidence
Auto Election
Auto repair/replace election notice must be sent within 7 days after receipt of proof of loss (versus 30 days for property/fire).
Interest for Wrongful Withholding
If an insurer wrongfully withholds payment due under a contract, it is liable to pay interest from the date payment became due at the prescribed rate.
